Is basement wall insulation required by Machusetts building code?

I bought a recently renovated condo last year. Last week I found some spots inside the basement wall have no insulation at all. My electrician reached inside the drywall and can touch the foundation. That explains why my basement is always cold, and there is one wall always feels freezing cold. I still have a warranty from the builder, but they deny that insulation is required and refuse to correct the problem.
